Welcome to Noxie. These Terms of Service ("Terms") govern your access to and use of the Noxie mobile application, website, and related services (collectively, the "Service"). By downloading, installing, or using Noxie, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Eligibility
Noxie is available to users of all ages. If you are a minor in your jurisdiction, you confirm that you have the consent of a parent or legal guardian to use this Service.
2. Account Registration
- Account Creation: You may create an account using your email address, Google Sign-In, or Apple Sign-In. You may also use the app anonymously without creating an account.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- Accurate Information: You agree to provide accurate and complete information during registration and to keep your account information up to date.
- Single Device Policy: Each account is designed for use by a single individual. Sharing account credentials is not permitted.
3. Use of the Service
3.1. Permitted Use
Noxie grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial educational purposes.
3.2. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Attempt to manipulate game scores, leaderboards, streaks, or the lightning system through automated means, bots, scripts, or any form of cheating.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Interfere with or disrupt the integrity or performance of the Service or its servers.
- Create multiple accounts to gain unfair advantages in leagues or leaderboards.
- Exploit the ad reward system (lightning recovery via ads) through fraudulent means.
We reserve the right to suspend or terminate accounts that violate these rules without prior notice.
4. Game Mechanics and Virtual Items
- Lightnings: Free users receive 5 lightnings daily (reset at UTC 00:00). Additional lightnings can be earned by watching rewarded advertisements. Lightnings have no monetary value and cannot be traded, sold, or transferred.
- Leagues & Tiers: The leaderboard and tier system (Bronze, Silver, Gold, Diamond, Master) is calculated weekly. Promotion and demotion are based on relative performance within each league.
- Scores: All scoring is calculated server-side with anti-cheat measures. We reserve the right to adjust or reset scores if manipulation is detected.
5. Paid Services and Subscriptions
- Subscription Plans: Noxie offers "Explorer" (free) and "Legend" (premium) tiers. Premium subscriptions provide benefits such as unlimited lightnings and an ad-free experience. Current pricing is displayed within the app.
- Payment: Payment is charged to your Apple App Store or Google Play Store account at confirmation of purchase.
- Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
- Cancellation: You can manage and cancel your subscriptions through your device's account settings (Apple ID Settings or Google Play Subscriptions). Deleting the app does not cancel your subscription.
- Refunds: Refund requests are handled directly by the respective store (Apple App Store or Google Play Store) in accordance with their refund policies.
6. Advertisements and Third-Party Services
The free version of Noxie displays advertisements provided by third-party ad networks, including Google AdMob, AppLovin, Unity Ads, and Meta Audience Network.
- We have no control over the content of third-party advertisements.
- Interaction with advertisements is at your own risk.
- You may manage your advertising preferences through your device settings or by upgrading to a Legend subscription for an ad-free experience.
7. Intellectual Property
- Our Content: All content within Noxie — including but not limited to audio files, images, text, graphics, logos, the "Echo" mascot, game mechanics, and software — is the property of Noxie and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
- Feedback: Any feedback, suggestions, or ideas you provide regarding the Service may be used by us without any obligation to you.
8. Account Deletion
You may delete your account and all associated data at any time through the "Delete Account" option in the app settings. This action is permanent and irreversible. Upon deletion, all personal data, game history, statistics, and subscription associations will be permanently removed from our servers. 9. Service Availability
We work hard to keep Noxie running smoothly, but like any online service, occasional interruptions, bugs, or maintenance downtime may occur. We continuously improve the app and appreciate your patience during these times. We cannot guarantee that the Service will always be available or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, Noxie and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, loss of profits, service interruptions, or damages resulting from third-party content or advertisements.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using Noxie, you consent to the practices described therein.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes through an in-app notification or via email. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the applicable laws of the jurisdiction in which the operator of the Service is established, without regard to its conflict of law provisions.
